Usage Agreements - Tetra Europe
We take data protection and confidentiality extremely seriously and comply with national and European data protection regulations. We therefore want to explain the most important aspects with regard to the collection, processing and use of data, particularly which information and personal data is stored and how we handle it.
Further or deviating data protection provisions may exist in relation to individual offers or services provided via our website. You shall be provided with these special provisions within the scope of the offer or service and they shall take precedence over the general provisions.
1. Data controller
The entity responsible for the collection, processing and use of your personal data as defined by Germany’s Federal Data Protection Act is Tetra GmbH, Herrenteich 78, 49324 Melle, Germany.
2. 2. Collection, processing and use of personal data
2.1. Personal data
The term ‘personal data’ refers to individual information about personal or material circumstances of an identified or identifiable natural person.
This particularly includes your name, e-mail address, telephone number, address and date of birth as well as all inventory data that you provide us within the scope of an online order, registration, customer account creation or enquiry using our contact form (hereinafter simply referred as ‘data’).
It does not include statistical data that we collect by default for technical reasons when you visit our website and which cannot be directly linked to you. This includes information about how often you access our website, how much time you spend on it and the pages you access as well as about browsers, IP addresses and software and hardware properties. This information is collected and processed in anonymised format in order to find out about the use of our website and accordingly optimise this.
2.2. Collection, processing and use of your data
Our website can generally be used without having to enter data. If data is collected on our website, this shall, in so far as possible, occur on a voluntary basis.
All of the data that we have obtained about you within the scope of our business relationship shall solely be collected, processed and used for the purpose stated when you entered your data, for example to process your enquiry, to perform the agreements entered into with you, to deliver ordered products, to make payments, for advertising purposes, in particular the provision of newsletters (see point 3), or for technical administration purposes.
In the event that you disclose any data about other persons, such the name of your spouse or work colleagues, we shall assume that said person has given you the necessary permission to disclose such information.
Persons under the age of 18 may not provide us with any data without the permission of their parents or legal representatives.
Your data shall only be disclosed to third parties, in particular agencies that we have commissioned, if this is necessary to implement and perform certain actions and you have consented to the data transfer in advance. If we commission other companies to conduct our duties within the scope of order data processing and disclose your data to this end, said companies shall naturally be obliged to protect your data and only use it for the precisely specified purpose.
3. E-mail newsletter
We publish our newsletter using MailChimp, a newsletter tool from The Rocket Science Group, LLC (675 Ponce de Leon Ave NE, Suite 5000, Atlanta, GA 30308 USA; ‘MailChimp’). The data is stored on servers in the USA. MailChimp is certified to the data protection agreement EU-US Privacy Shield. We have furthermore entered into a data processing agreement with MailChimp. MailChimp will only use your e-mail address on our behalf and will not write to you itself. MailChimp offers the ability to statistically analyse usage data. This includes information such as whether an e-mail has reached the recipient or was rejected by the server and which links have been clicked.
Further information about data protection and the cookies used can be found online at http://mailchimp.com/legal/privacy.
You can cancel your newsletter subscription with immediate effect at any time and without explanation. To unsubscribe, simply click the link in the e-mail, use our contact form or e-mail firstname.lastname@example.org.
5. Data security
We endeavour to use all technical and organisational possibilities to store your data in a way that it is inaccessible for third parties.
All data is stored on servers which are operated to high security standards and are protected against access by unauthorised persons and misuse.
6. Public procedure register for general access (Sections 4e no. 1 – 8 and 4g(2) BDSG)
Ensuring data protection, i.e. protecting your personal rights, is extremely important to us. You can rest assured that we will handle your data responsibly and have taken the necessary technical and organisational measures to guarantee the highest possible level of security for the data stored.
Pursuant to Section 4g(2) of Germany’s Federal Data Protection Act (BDSG), the data protection officer is required to make the information specified in Section 4e(1) numbers 1 – 8 BDSG available in a suitable form to anyone who requests it. We hereby directly comply with this obligation, waiving submission of an individual request on your part.
