App terms of use
1. Provider and content
The ‘Tetra Aquatics App’ (hereinafter abbreviated to ‘App’) is offered by Tetra GmbH, Herrenteich 78, 49324 Melle, Germany, Osnabrück District Court (HRB 19028) (hereinafter ‘Tetra’) as an information and communication medium to help you find the appropriate Tetra care product and animal food for your desired use.
2. Cost
Tetra does not charge for the use of the App. The mobile internet costs depend on your provider’s tariffs.
3. Technical parameters and registration
The technical parameters for using the App are based on the requirements specified in the download area. Registration is required in order to use certain App functions.
4. Usage restrictions
You hereby agree
- not to incorporate the App or any of its individual components into other media without our prior written consent;
- not to access the App content through technologies other than those provided in our App for purposes that we have defined;
- not to modify any parts of the App or their content;
- not to bypass, disable or interfere with the App security precautions and not to bypass any precautions that prevent or restrict access or the copying of content;
- not to use the App for business or commercial purposes.
5. Copyrights
Unless otherwise expressly indicated, all information in the App, including but not limited to the texts, images, graphical representations and audio and video files (hereinafter ‘content’) is the property of Tetra and used by Tetra within the scope of a licensing agreement. All content is protected by copyright laws, trademark laws or otherwise for Tetra or its licensor.
No content may be duplicated, modified, transmitted, re-used, made newly available, exploited or otherwise used for public or commercial purposes without Tetra’s prior written consent.
6. Liability
In the App, Tetra provides information that is as factually accurate and clear as possible. Despite all the due care, incorrect information may still be accidentally provided. Tetra therefore disclaims all liability for typographical errors and misprints as well as for the accuracy, completeness and up-to-date nature of the information contained in the App.
If the App contains links or pointers to third-party websites, Tetra does not assume any responsibility for the information, notices, materials or links to other websites that these provide. Tetra in no way recognises the content of linked websites as its own.
In using the App, you shall bear all risks associated with the usage, including any damage to your device, the software or data by viruses or other software transmitted or activated via our website or your access to this.
Tetra does not assume any liability for the unauthorised use of the App and the associated breaches of third-party rights.
Liability claims against Tetra with regard to material or non-material damages caused by the use or non-use of the information provided or through the use of incorrect and/or incomplete information are excluded providing they cannot be shown to be the result of a wilful or grossly negligent dereliction of duty by Tetra. The same applies to any damages caused by the use of the battery recommended by the App.
7. Data security and data protection
The rules and information from Tetra found under the ‘Datenschutzerklärung (Privacy Statement)’ tab apply with regard to data security and data protection.
8. Final provisions
The conditions of the end consumer licensing agreement for licensed applications particular apply to the use of the App. These can be found at www.apple.com for the iOS version of the App and at play.google.com for the android version.
Tetra expressly retains the right to modify, expand or delete parts of pages or the entire website without prior notice or to cease publication temporarily or permanently.
The accessible statements and information solely apply within the scope of the laws of the Federal Republic of Germany.
